This Privacy Policy explains what information we collect when you visit nextgenerationcapital.us (the “Site”), submit a form, join an interest list, tour a community, or exchange text messages with us, and how we use, share, and protect that information.
By using the Site or providing us with information, you agree to this Privacy Policy. If you do not agree, please do not use the Site or submit information to us.

Information you give us
When you fill out a form, join an interest list, request a tour, or otherwise contact us, we may collect:
- Name, email address, phone number, mailing address, and ZIP code
- Community or home preferences (floor plan interest, price range, timing, financing status)
- Any notes, questions, or messages you send us via forms, email, or text
- Records of tours you request or attend, and correspondence with our sales team or brokers
Information collected automatically
When you visit the Site, we automatically collect certain technical information, including:
- Browser type, device type, operating system, and screen size
- IP address and approximate location derived from IP
- Referring URL, pages viewed, links clicked, and time spent on pages
- Cookie identifiers and similar tracking technology (see Section 5)
Information from third parties
We may receive information about you from advertising and analytics partners when you interact with our ads or listings, subject to their respective privacy policies. This includes:
- Meta / Facebook Lead Ads and Instagram lead forms: If you submit a lead form on a Meta property (Facebook or Instagram) associated with NGC, Meta will share the information you provided in that form (such as name, email address, phone number, and community preferences) with NGC for the purpose of following up on your inquiry. Your interactions with those ads are also subject to Meta’s privacy policy.
- Google Ads and Google Analytics: Aggregated and cookie-based data about how you found and interacted with our Site and ads.
- Third-party listing services such as Zillow, Redfin, and NewHomeSource, when you submit an inquiry about one of our homes through their platforms.
2. How we use information
We use the information we collect to:
- Respond to your inquiries, requests, and applications
- Schedule tours, follow up on interest, and provide community and pricing information
- Send you marketing emails, texts, or mailings about our communities, events, and available homes (only when you’ve opted in — see Section 3)
- Operate, maintain, secure, and improve the Site
- Measure the performance of our advertising and content
- Comply with our legal, tax, and regulatory obligations
- Detect, prevent, and respond to fraud, abuse, or security incidents
3. SMS / text messaging
This SMS policy applies to Next Generation Capital and the following communities: Ventris Place, Northpointe Reserve, Courtyards at Cotton Lane (DOS LLC DBA Courtyards at Cotton Lane), and The Enclave at Airport.
Express consent
By opting into any Next Generation Capital text program, you expressly consent to receive recurring marketing and/or transactional text messages that may be sent using an automatic telephone dialing system, by or on behalf of Next Generation Capital, at the cell phone number you provide us. You also consent to receive transactional, operational, or informational text messages at that phone number, including appointment reminders. Please note we may not be able to deliver messages to all mobile carriers. Consent to receive texts is not a condition of purchasing any goods or services from NGC, and you understand and agree that all text messages may be sent using automated technology. Message and data rates may apply.
You may opt in by checking an SMS opt-in box on a form on this Site, texting us first, or by providing verbal consent to a sales agent who confirms the opt-in in writing.
What we send
Once you’ve opted in, we may send text messages related to:
- Responses to questions you’ve asked
- Tour scheduling, confirmations, appointment reminders, and follow-up
- Community updates, new home releases, pricing changes, and events
- Follow-up from our sales team or brokers
What to expect
- Communications will be delivered via SMS.
- Message frequency may vary depending on campaigns, product updates, or your level of engagement.
- Message and data rates may apply. Message frequency varies.
- Consent to receive text messages is not a condition of purchasing any property, product, or service from NGC.
Your choices and control
- Participation in the Marketing Program is optional and not required to use our core services.
- You may opt out at any time by following the unsubscribe instructions included in our messages. We will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
- Opting out of marketing communications will not affect transactional or service-related messages (such as account notifications).
- By opting in, you confirm that you are authorized to receive communications at the contact information you provide and that you understand your consent may be withdrawn at any time.
STOP and HELP
You can cancel the SMS service at any time. Simply text STOP to the number sending the messages. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.
We do not share your mobile opt-in for marketing
Mobile opt-in data and consent to receive text messages will not be shared with third parties or affiliates for their own marketing purposes. Mobile information and SMS opt-in consent are not sold, transferred, or otherwise disclosed to third parties for their own advertising or marketing use. We share mobile information only with the service providers who help us send those messages on our behalf (for example, our SMS platform provider), and only for the purpose of delivering those messages.
4. How we share information
We do not sell your personal information. We share information only as follows:
- Service providers. Vendors who host the Site, send our emails and text messages, provide CRM/sales tools, process forms, and analyze traffic — bound by confidentiality and use restrictions.
- Affiliated companies. Our affiliated brokerage, construction, and capital entities involved in the same transaction or communication you initiated (for example, our licensed real estate brokerage Pacific Capital Brokers, Inc., DRE Lic. #01291111, when you request brokerage services).
- Advertising partners. Aggregated, de-identified, or cookie-based data with advertising and analytics partners such as Google and Meta to measure and improve our campaigns (never your SMS opt-in).
- Legal and safety. When required by law, subpoena, or legal process, or to protect our rights, property, employees, customers, or the public.
- Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to standard confidentiality protections.
5. Cookies and analytics
The Site uses cookies and similar technologies to remember your preferences, measure traffic, and support advertising. Categories include:
- Strictly necessary — required for the Site to function.
- Analytics — Google Analytics and similar tools that tell us how visitors use the Site.
- Advertising — Google Ads and Meta pixels used to measure ad performance and, where permitted, show relevant ads on other sites.
Most browsers let you refuse cookies or clear them. You can also opt out of many advertising cookies through aboutads.info/choices or youronlinechoices.eu. Google Analytics can be opted out of via tools.google.com/dlpage/gaoptout.

- Request that we correct or delete your information
- Unsubscribe from marketing emails (or use the “unsubscribe” link in any message)
- Opt out of text messages (reply STOP to any text)
If you are a California resident, the California Consumer Privacy Act (CCPA/CPRA) gives you the right to know what personal information we collect, use, and disclose about you; to request deletion or correction of your information; to opt out of the “sale” or “sharing” of your personal information (we do not sell or share your personal information for cross-context behavioral advertising in exchange for money); and to be free from discrimination for exercising these rights. To exercise these rights, contact us using the information in Section 11. We may need to verify your identity before responding.
7. How we protect information
We use industry-standard administrative, technical, and physical safeguards to protect the information we collect, including encrypted transmission (HTTPS) and access controls on our internal systems. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
8. Data retention
We retain personal information as long as needed to provide the services you’ve requested, comply with our legal, tax, and recordkeeping obligations, resolve disputes, and enforce our agreements. Sales and real-estate records are typically retained for the longer of any period required by California real estate and tax law or seven (7) years.
9. Children’s privacy
The Site is intended for adults. We do not knowingly collect personal information from anyone under 16. If you believe a child under 16 has provided us with personal information, please contact us and we will take reasonable steps to delete it.
10. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will update the “Last Updated” date at the top of this page. Material changes will be flagged more prominently — for example, in a Site notice or a message on the community page. Your continued use of the Site after an update means you accept the updated policy.
